Terms and Conditions

The Ocho – Luxury Villa Rentals

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of The Ocho platform and services ("Platform") operated by The Ocho ("we," "us," or "our"). By accessing our Platform or making a reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms.

The Ocho acts as an intermediary platform connecting guests with luxury villa properties. We facilitate bookings, process payments, and coordinate guest services on behalf of property owners and management companies.


2. Definitions

Throughout these Terms, the following definitions apply:

"Guest" refers to the individual making a reservation and all persons included in that reservation.

"Property" means any villa, residence, or accommodation listed on our Platform.

"Owner" designates the legal owner or authorized representative of a Property.

"Booking" constitutes a confirmed reservation for a specific Property and date range.

"Rental Period" encompasses the dates from check-in to check-out as specified in your Booking confirmation.

"Total Rental Amount" includes the accommodation fee, applicable taxes, service charges, and any additional fees as itemized in your Booking confirmation.


3. Eligibility and Account Requirements

To make a Booking through our Platform, you must be at least 18 years of age with full legal capacity to enter into binding agreements. You represent that all information provided during the booking process is accurate, current, and complete. You agree to maintain the confidentiality of any account credentials and accept responsibility for all activities conducted under your account.


4. Reservation Process

4.1 Booking Requests

Submitting a booking request does not guarantee availability. A Booking becomes confirmed only upon receipt of our written confirmation and successful processing of the required deposit or payment.

4.2 Confirmation

Upon confirmation, you will receive a detailed Booking confirmation containing the Property address, Rental Period, Total Rental Amount, payment schedule, and any specific Property rules or requirements.

4.3 Guest Information

You must provide accurate details for all guests who will occupy the Property. The maximum occupancy stated in your Booking confirmation must not be exceeded without prior written consent.


5. Payment Terms

5.1 Deposit

A deposit of 30% of the Total Rental Amount is required to confirm your Booking. This deposit must be received within 7 days of your booking request unless otherwise specified.

5.2 Balance Payment

The remaining balance is due 60 days prior to the check-in date. For Bookings made within 60 days of the check-in date, the full Total Rental Amount is due at the time of booking.

5.3 Accepted Payment Methods

We accept major credit cards, bank transfers, and other payment methods as specified on our Platform. All payments must be made in the currency indicated in your Booking confirmation.

5.4 Security Deposit

A refundable security deposit may be required for certain Properties. The amount will be specified in your Booking confirmation and will be refunded within 14 days following check-out, less any deductions for damages, excessive cleaning, or other charges as permitted under these Terms.


6. Cancellation Policy

6.1 Cancellation by Guest

Cancellations must be submitted in writing. The following cancellation fees apply based on when notice is received:

  • More than 90 days before check-in: Full refund minus a €150 administrative fee
  • 60-90 days before check-in: 50% of the Total Rental Amount retained
  • 30-59 days before check-in: 75% of the Total Rental Amount retained
  • Less than 30 days before check-in: 100% of the Total Rental Amount retained

6.2 Cancellation by The Ocho

Should we need to cancel your Booking due to circumstances beyond reasonable control, we will offer you either a full refund or alternative accommodation of comparable standard and value. We are not liable for additional expenses such as travel costs or consequential losses arising from cancellation.

6.3 Modifications

Changes to your Booking (dates, Property, guest numbers) are subject to availability and may incur modification fees. We reserve the right to decline modification requests.


7. Check-In and Check-Out

7.1 Check-In

Standard check-in time is 15:00 (3:00 PM) local time unless otherwise specified. Early check-in may be available upon request and may incur additional charges.

7.2 Check-Out

Standard check-out time is 11:00 (11:00 AM) local time unless otherwise specified. Late check-out may be available upon request and may incur additional charges.

7.3 Key Collection

Check-in procedures and key collection instructions will be provided in your pre-arrival communication. You are responsible for the safekeeping of all keys and access devices.


8. Guest Responsibilities

8.1 Property Care

You agree to treat the Property with care and respect, maintaining it in the same condition as found upon arrival. You are responsible for any damage caused by you or members of your party during the Rental Period, excluding normal wear and tear.

8.2 House Rules

Each Property has specific house rules which will be communicated to you before or upon arrival. Failure to comply with house rules may result in termination of your stay without refund.

8.3 Prohibited Activities

The following are strictly prohibited unless expressly permitted in writing: events, parties, or gatherings exceeding the stated occupancy; commercial photography or filming; subletting or assigning your Booking; any illegal activities; excessive noise or disturbance to neighbors.

8.4 Reporting Issues

Any defects, damages, or issues with the Property must be reported to us immediately. Failure to report issues promptly may affect your right to compensation or remedy.


9. Services and Amenities

9.1 Included Services

Services included in your Booking (housekeeping, pool maintenance, garden care, etc.) are specified in your Booking confirmation. The frequency and scope of included services may vary by Property.

9.2 Additional Services

Additional services such as private chef, spa treatments, excursions, or transportation can be arranged upon request and will be charged separately. These services may be provided by third-party vendors.

9.3 Staff

Where staff are provided, you agree to treat all staff members with respect and courtesy. Any complaints regarding staff should be directed to us immediately.


10. Liability and Insurance

10.1 Limitation of Liability

To the maximum extent permitted by law, The Ocho shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your Booking or stay. Our total liability shall not exceed the Total Rental Amount paid for your Booking.

10.2 Property Owner Liability

Property Owners maintain their own insurance coverage. We recommend that guests obtain comprehensive travel insurance covering cancellation, medical emergencies, personal belongings, and liability.

10.3 Guest Insurance

We strongly recommend that all guests obtain appropriate travel insurance before their Rental Period. This should include coverage for trip cancellation, medical emergencies, personal liability, and loss or damage to personal belongings.

10.4 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or other force majeure events.


11. Intellectual Property

All content on our Platform, including text, graphics, logos, images, and software, is the property of The Ocho or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.


12. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By making a Booking, you consent to the collection and processing of your data as described in our Privacy Policy.


13. Complaints and Disputes

13.1 Complaints Procedure

Any complaints during your stay should be reported to us immediately to allow for prompt resolution. Complaints received after departure will be considered but our ability to investigate and resolve may be limited.

13.2 Resolution

We aim to resolve all complaints within 28 days of receipt. If we cannot resolve a dispute, you may pursue mediation or other dispute resolution mechanisms.


14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms or your Booking shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws of your country of residence provide otherwise.


15. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Platform. Your continued use of our services following any changes constitutes acceptance of the modified Terms. The Terms applicable to your Booking are those in effect at the time of your Booking confirmation.


16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
